I am pretty sure that Ubuntu does not use the real-time kernel patch. So this "patch to the patch" is not relevant. See http://en.wikipedia.org/wiki/RTLinux

Actually, I believe that Ubuntu does indeed have an RT patched kernel.

RTLinux and PREEMPT_RT

RTLinux and PREEMPT_RT are different beast. IIRC in RTLinux linux run as a process on top of a rt kernel, with -rt patch linux is the rt kernel. RTLinux is covered by patend, see lwn.
